Your personal data and Lloyds Banking Group
If you are a customer of a Lloyds Banking Group company, details of the information we collect and how we use it will also be set out in the terms and conditions of the product or service which you hold. In the event of a conflict between this Privacy policy and the terms and conditions of your specific product or service, the terms and conditions of your specific product or service will take precedence.
You agree that we may keep your personal details, given to us by you or other people during your relationship with us and with other companies in our group, in any database of the Lloyds Banking Group. This includes:
- details you give us on application forms;
- details you give us during financial reviews and interviews;
- our analysis of your banking transactions; and
- what we know from operating your accounts.
Companies in our group may use and update this centrally held information to: - provide you with services;
- identify products and services which might be suitable for you;
- assess lending and insurance risks;
- recover debts;
- prevent and detect fraud; and
update their own records about you.
We may also use your information for research and statistical analysis with the aim of improving our services. If you request it, we will provide you with a copy of the information we hold, in line with the Data Protection rules. We may charge for this service, according to the Data Protection rules relevant to your jurisdiction.
The information we hold about you is confidential. We will only disclose it outside the Lloyds Banking Group when:
- you give us your consent;
- it is needed by our agents and others involved in running accounts and services for you;
- we or others need to investigate or prevent crime;
- the law permits or requires it, even without your consent, or there is a duty to the public to reveal the information.
Lloyds TSB Private Banking may provide services or administer your account from centres in countries outside the EEA (such as Switzerland and the USA) that do not always have the same standard of data protection. However, we will be bound by our obligations under relevant local Data Protection rules even when your personal information is processed outside the EEA.
Personal contact is an important part of the service and your Relationship Manager may contact you personally to inform you about products and services offered by Lloyds Banking Group and others that he or she thinks are relevant to you, based on his or her understanding of your financial needs.
Confidentiality
Subject to the paragraph below, we shall not, without your prior written consent, use or disclose any information relating to your affairs, business, investments, finances or other matters of a confidential nature except to the extent that such use or disclosure is required by law or any regulatory authority or is necessary to enable us to properly perform our obligations.
The obligations in this section shall not apply to any confidential information that we hold otherwise than as a result of this Agreement, or that becomes public without any breach by us of our confidentiality obligation under this Agreement. For the avoidance of doubt, we will be entitled to disclose confidential information if we are required or requested to do so by a relevant regulatory or tax authority or under any Applicable Regulations.
We are not obliged to disclose to you or to take into consideration or use for your benefit any fact, matter or thing:
if, in our reasonable opinion, disclosure of the information would or might be a breach of duty or confidence to any other person or may make our employees liable to criminal or civil proceedings; or
which comes to the notice of an officer, employee or agent of ours but does not come to the actual notice of the individual or individuals with whom you are dealing.
